1. Introduction

Welcome to Yellow Tree Reading  (Pty) Ltd (“Yellow Tree”, “we”, “our”, “us”).
These Terms and Conditions (“Terms”) govern your use of our website, online courses, and downloadable literacy resources (collectively, the “Services”).


By purchasing, enrolling, or using our website, you agree to these Terms, our Privacy Policy, and South African laws including the Consumer Protection Act 68 of 2008 (CPA), Electronic Communications and Transactions Act 25 of 2002 (ECTA), and Protection of Personal Information Act 4 of 2013 (POPIA).

If you do not agree, please do not use our website or Services.

3. Use of This Website

You agree to use this website only for lawful educational and personal purposes.


You may not:

  • Use it for any fraudulent, unlawful, or commercial resale purpose;

  • Interfere with its operation, servers, or networks;

  • Reproduce, copy, or distribute website content without written permission.
     

Violation of these rules may result in suspension or legal action.

 

4. Eligibility and Use


Our Services are designed for children and adults — including educators, therapists, parents, and guardians — who use our literacy resources for teaching and learning purposes.

Purchases, registrations, and account creation must be completed by an adult (18 years or older) or by a parent, guardian, or educator acting with verified parental consent.

Where a child under 18 uses our Services:

  • A parent or legal guardian (or an educator who has obtained parental permission) must authorise the child’s participation and any associated data processing.

  • We collect and use a child’s personal information only to the extent necessary for educational use and with that verified consent.

  • We do not knowingly enter into contracts directly with minors or use children’s data for marketing or profiling.
     

By registering, purchasing, or allowing a child to access our digital materials, you confirm that you are a competent person as defined under the Protection of Personal Information Act 4 of 2013, and that you have provided lawful consent on behalf of the child.

 

5. Formation of Contract

When you make a purchase on our website:

  1. You make an offer to purchase digital content.

  2. A legally binding contract is formed when we send a confirmation email or provide access to the content.
     

All online sales are concluded electronically in accordance with ECTA, Chapter 7.

 

6. Product Descriptions

We make every effort to describe our courses, games, and resources accurately.
If you believe that any product or description is misleading, please notify support@yellowtreereading.com immediately so that we can correct it.

 

7. Pricing and Payment

Prices are listed in various currencies and are stated exclusive of VAT, as Yellow Tree Reading  (Pty) Ltd is not a VAT-registered company.
 

The total amount due will be displayed at checkout before you confirm your order.
 

Payments are processed securely through PayFast / Paypal /Paystack.

By submitting your payment details, you confirm that:
 

  • You are authorised to use the selected payment method; and

  • All billing information you provide is true, accurate, and current.
     

Payment is due immediately upon checkout, and access to digital content is granted once payment is successfully received.

 

 

8. Delivery of Digital Products

All Yellow Tree resources and products are delivered digitally. Once your payment has been successfully processed, you will receive your download links or access credentials via email.

If you have not received access within 2 hours of purchase, please contact us at support@yellowtreereading.com so we can assist you promptly.

Please note: there are no physical products or deliveries associated with our resources.

 

 

 

9. Refunds, Returns, and Cancellations

Downloadable Products (Games, Activities and Resources):

Because our games and stories are digital and delivered instantly, all games, booklets, pdf’s, audio stories, activities or other resource sales are final and non-refundable.

Once access, activation, or download has occurred, no refunds, exchanges, or cancellations will be processed.

Online Courses:

You can, however, explore our digital courses risk-free. If you decide it’s not the right fit and your watch time is still under the first five lessons, we’ll gladly refund your purchase.

By completing your purchase, you acknowledge that access to our digital content constitutes delivery in full, and you permanently waive any right to cancel or demand a refund after that point.

Legal Basis:

This policy complies with the Electronic Communications and Transactions Act 25 of 2002 (ECTA) — which excludes digital content that has been accessed or downloaded from the seven-day cooling-off right (Section 44) — and with the Consumer Protection Act 68 of 2008 (CPA), provided that the product functions as described.

Yellow Tree Reading (Pty) Ltd ensures all digital resources are accurately represented and functional at the time of sale.


If a technical issue prevents delivery that is within our control, we will restore access or re-issue the product.

 

10. Licence of Use

When you purchase any Yellow Tree Reading materials or resources, you receive a personal, non-exclusive, non-transferable licence to use the content for your own teaching, therapy, or home-learning purposes.

Apply for a School or multi-person license, email us at admin@yellowtreereading.co.za.

You may not:

  • Copy, resell, or share the material publicly;

  • Upload it to third-party platforms; or

  • Use it commercially without written permission.
     

All intellectual-property rights remain owned by Yellow Tree Reading (Pty) Ltd.

 

11. Consumer Protection Act (CPA) Rights

As a consumer, you are entitled to fair, transparent, and reasonable terms under the CPA.


In particular:

  • All prices are displayed clearly and inclusively.

  • You have the right to cancel pre-orders or recurring subscriptions with notice.

  • You may lodge complaints with the National Consumer Commission (NCC) if you believe your consumer rights have been violated.

12. Privacy and Data Protection

Your personal information is processed according to our POPIA-compliant Privacy Policy.


By using our website, you consent to lawful processing and international transfer of your information to our trusted service providers.

At Yellow Tree Reading (Pty) Ltd, we believe every child learns in their own unique way and at their own pace.


Our digital resources and training programmes are designed to support growth and inspire confidence, but individual learning outcomes may vary depending on each learner’s circumstances, effort, and support environment.

Accordingly, while we stand behind the quality and accuracy of our materials, we do not guarantee specific educational or developmental results.

Except where required by South African law:

  • Our Services are provided “as is”, without express or implied warranties of performance or fitness for a particular purpose.

  • We are not liable for any indirect, incidental, or consequential loss or damages arising from the use or inability to use our products or services.

  • Our total liability for any claim will not exceed the amount paid for the product or service concerned.

 

14. Intellectual Property

All text, videos, images, course materials, and logos appearing on this site are the intellectual property of Yellow Tree Reading (Pty) Ltd.


You may not reproduce or distribute our materials without prior written consent.

 

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa.


Any disputes arising shall be resolved under the jurisdiction of the High Court of South Africa, Western Cape Division, or any competent consumer tribunal in your region.

 

16. Updates to These Terms

We may update these Terms periodically.
The version date at the top indicates the latest revision.
Any material changes will be communicated via email or published on our website.
